Having been a prosecuting attorney for almost 8 years in the
District Attorney's office in Arapahoe County, I have prosecuted
a number of these cases and believe that victims of sexual
assault have rights and if they have the emotional strength
and desire to pursue these cases may in some instances recover
damages for physical, emotional and psychological distress.
These are difficult cases for the victim to pursue and there's
always a problem in collecting damages because it is extremely
unlikely for there to be any insurance available to the defendant.
In these cases there is a 1 year statute of limitations, meaning
that if you were to file the lawsuit you would need to file
so within one year from the date of the incident or you would
be forever barred.
